So basically, to test if your phone will power on by software, set an alarm for 5 minutes from now. Then turn off your phone. If it powers on to sound the alarm, then your phone "could" be used as a remote mic when powered off. Of course, how many of us actually ever turn our phones off all that often. So the remote mic could be used all the time against most of us. Sadly, while I am for certain powers of the government to spy and protect and such, these are the things that slowly take away all of our freedoms.

It still requires a court order.

However, with data mining, an entire region (geographic or demographic) could be analyzed.

I tend to lean towards the "If I am not doing anything wrong, who cares" argument. But it is a slippery slope that leads to '1984'.

And anyone who uses GPS phone software has to turn on the "Always on" GPS tracker so they already know where you go if they were so inclined to check. Even with the "Always on" turned off, it still has active GPS for 911.
